Conditions of Participation Linkedln & Instagram Raffle of (1) 06.03.2023 and (2) 29.09.2023
Participation in the prize draws 1 & 2 of KÖLLA Global Management GmbH,
An der Gümpgesbrücke 7, 41564 Kaarst, is governed by the following provisions:
§ 1 Eligibility to participate
Only natural persons who have reached the age of 18 and reside in an EU country are eligible to participate. Excluded from participation are all persons who are involved in the implementation of the competitions. We reserve the right to exclude persons from participating in the competitions who manipulate or attempt to manipulate the entry process, the system and/or the prize draw and/or violate the conditions of participation. lf the excluded participant is a winner who has already been drawn, the prize may be subsequently withdrawn and a replacement winner drawn.
§ 2 Competition periods 1 + 2
- The competition will be held in the period from 06.03.2023 to 12.03.2023, 23:59.
- The competition will be held in the period from 29.09.2023 to 06.10.2023, 23:59.
§ 3 Participation
Participation is free of charge and only possible via Linkedln and Instagram. The competitions are in no way connected to the online social platforms Linkedln or Instagram and are in no way organised or supported by Linkedln and Instagram.
(1) In order to participate, an eligible person must follow the Linkedln page of “KÖLLA , The fruit Company” and respond to the Linkedln post dated (1) 06.03.2023, or (2) 29.09.2023 of “KÖLLA – The fruit Company” with a “like” sign mentioned in the competition. Each person may only participate once per game period.
(2) In order to participate, an eligible person must follow the Instagram page “koella.1921” and respond to the Instagram post dated (1) 06.03.2023, or (2) 29.09.2023 of “koella.1921” with a “like” sign mentioned in the competition. Each person may only participate once per game period.
Participation via different Instagram accounts and participation via machine-generated “Like” function/comments is not permitted. The statements of all participants are subject to the rules of our netiquette. Comments with inhuman, discriminatory, defamatory, offensive or otherwise illegal content will not be considered. Comments received after the closing date of the competition will not be considered for the draw, regardless of the reason for the delay.
§ 5 Prize draw procedure and prize
After the closing date, a total of 2×2 A1 photos on Dibond will be raffled among all participants – 1x in March and 1x in October. Each participant has the chance to win once.
§ 6 Notification of Winnings and Acceptance of Winnings within the Time Limit
After the draws, the winners will be notified by private Linkedln or Instagram message. This notification of the winners is without guarantee.
The winners will be selected at random on (1) 13.03.2023 and (2) 09.10.2023.
On (1) 16.03.2023 or (2) 10.10.2023, the winners will be contacted. The winners must inform us of their address by (1) 20.03.2023 or (2) 17.10.2023, 12 noon, via the private message. Otherwise the prize will be forfeited without compensation. There is no obligation to make further enquiries, but in this case the right to conduct a substitute draw.
§ 7 Profit processing and costs
A cash payment of the prize value or an exchange of the prize is excluded. Winning claims may only be assigned to third parties with the prior consent of “KÖLLA Global Management GmbH”.
§ 8 Data protection
lf you enter our competitions, we will process your contact details and messages for the purpose of running the competition and sending you the prize.. The legal basis for this is Art. 6 para. 1 lit.
b) DS-GVO. You do not have to provide us with this data, however, you cannot participate in the competition without providing this data. The participant assures that the personal data provided by him/her, in particular first name, surname, address and e-mail address, are true and correct. All data will be deleted no later than 30 days after the end of the competition. Participants are entitled to the statutory rights to information, amendment, deletion and revocation.
§ 9 Early ending
We reserve the right to cancel or prematurely terminate the competitions in whole or in part at any time, even without observing deadlines, or to change the course of the competitions if it is not possible to ensure proper implementation of the competitions for technical reasons (e.g. computer virus, manipulation of or errors in software/hardware) or legal reasons or for reasons of force majeure. In such a case, the participants shall not be entitled to any claims against us.
§ 10 Linkedln & Instagram Notices and Conditions
As the competition campaigns take place within the Linkedln and Instagram platform, the following provisions also apply:
In addition to these conditions of participation, the relationship between the organiser “KÖLLA Global Management GmbH”, the participants and Linkedln and Instagram is determined by the conditions of participation and the data protection rules of Linkedln and Instagram.
Participants may not assert any claims against Linkedln or Instagram arising in connection with participation in and use of the competition. All enquiries and information regarding the competition should be directed to the organiser (socialmedia@koella.com) and not to Linkedln or Instagram.
§ 11 Revocation
The participant is free at any time to effect the deletion of his/her registration data by means of revocation at socialmedia@koella.com and thus to withdraw from participation.
§ 12 Other
Legal recourse is excluded. The law of the Federal Republic of Germany shall apply exclusively, to the exclusion of the UN Convention on Contracts for the International Sale of Goods.
